We at ServiceTitan, Inc., (“ServiceTitan,” “we,” “us,” or “our”) value and respect your privacy and are committed to protecting it through compliance with this policy. This Privacy Policy (this “Policy”) explains how ServiceTitan collects, uses, discloses, maintains and otherwise ‘processes’ the personal information described in this Policy, as well as the rights and choices individuals have regarding such personal information.  This Policy applies to the extent we process personal information on our own behalf, as a controller or business.  Please read this Policy carefully to understand our practices regarding your information and how we treat it

1. Scope and Background

This Policy applies to the personal information that ServiceTitan processes as a controller related to:   

  • our website www.servicetitan.com (the “Site”) and the services available through our website, as well as any related products, websites, downloadable software, applications, and other services provided by us that display or include a link to this Policy (collectively, together with the Site, our “Services”);

  • our current, former and prospective customers, vendors and partners; 

  • individuals who register for or participate in our webinars and other events;

  • individuals who request or register to receive news, information and marketing communications from us; 

  • individuals who participate in surveys or research conducted by us; and

  • individuals that communicate or engage with us related to our Services.

This Policy does not apply to the extent we process personal information on behalf of our business customers (each a “Business Customer”) as a processor or service provider (“Customer Data”).  In general, we act as a processor or service provider for Customer Data and process Customer Data on behalf of a particular Business Customer subject to the terms of our respective contracts with such Business Customers, who are controllers and businesses for their respective Customer Data.  Where we are processing Customer Data on behalf of our Business Customers, the Business Customer’s privacy policy will apply to the processing of such Customer Data.

In addition, this Policy does not apply to the personal information we collect and process about ServiceTitan employees and personnel, or job applicants and candidates.   

Other Notices and Terms. This Policy is incorporated into and is subject to the ServiceTitan Terms of use (available at www.servicetitan.com/legal/terms-of-use).  Capitalized terms used but not defined in this Policy have the meaning given to them in the ServiceTitan Terms of Use.  In some cases, additional or supplemental privacy notices (each an “Additional Notice”) may be provided and will apply to certain personal information collected and processed by ServiceTitan.  For example, we may provide an Additional Notice in order to provide more specific information about how we use and disclose personal information if you choose to take advantage of a particular partner promotion.  The Additional Notice will control in the event of a conflict with this Policy, with respect to processing of personal information that is subject to that Additional Notice.  

Customer Data.  Our Business Customers use ServiceTitan’s products and services to manage their businesses, including to engage with their own current, former and prospective clients, customers, personnel and others (referred to as “end users” herein), to manage appointments, quotes, billing and payments, and to otherwise support and manage key business functions, such as marketing, customer service, sales, engagement, reporting, accounting, productivity and business intelligence activities.  In providing our products and services to a Business Customer, ServiceTitan may collect, receive and otherwise process Customer Data, including personal information about end users, on behalf of that Business Customer.

2. Personal Information Collected and Processed

We obtain personal information relating to you from various sources as described below.  Where applicable, we indicate whether and why you must provide us with your personal information, as well as the consequences of failing to do so.  If you do not provide personal information when requested, you may not be able to benefit from our Services if that information is necessary to provide you with the service or if we are legally required to collect it.

a. Personal Information Collected Directly 

We may collect personal information about individuals directly from the individuals, which generally includes: 

  • Account registration.  If you register to use the Services, then you must provide us with your name, email address, and a password in order to create an account and user profile.  Some types of user registrations also require a physical address or location.  You may also optionally add other information, such as photos of yourself or, for some types of end-user registrations, your household.

  • Payment and billing information.  When you make payments to or through the Services, you may need to provide personal information to our third-party service providers, such as your credit card number and billing address.

  • Financing information.  If you apply for certain financing options, we, our Business Customers or third-party payment providers, as the case may be, may collect information such as your gender, birthdate, marital status and education and employment information as needed to process your applications with our financing partners.

  • Communications.  We will collect any information which you provide to us through your communications (e.g., when you communicate with our customer support team).

b. Personal Information Collected via Automated Means

In addition to information that you provide directly, we may collect information about you and your use of the Services via automated means, such as cookies, web beacons and similar technologies, including:

  • Location information.  We may collect and store your location information, including GPS coordinates, if you enable your mobile device to send it to us.  Collection of this information may improve the provision of the Services.

  • Cookies and similar technologies.  When you use the Services, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your device.  We may use both session cookies and persistent cookies to automatically collect certain information.  A session cookie disappears after you close your browser.  A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Services.  When you use the Services, we may also automatically collect certain information from your device by using similar technologies, including “clear gifs” or “web beacons.”  For more information on our use of cookies and similar technologies, see Section 6. c. Personal Information Obtained from Third Parties

In accordance with applicable laws, we may collect personal information about you from third-party sources, such as public databases, joint marketing partners, social media platforms or other third-party platforms. For example, if you post information or engage with us on third party platforms we may collect personal information about you related to that third party platform or account. In many cases you can control what personal information you share with us through privacy settings available on those third-party social media services. 

In addition, we may receive lead and prospect information from third parties about businesses that may be interested in our products and services.  We may also engage with third parties to enhance or update our customer information. 

d. Customer Data Processed by ServiceTitan

As noted above, ServiceTitan collects and processes Customer Data on behalf of our Business Customers who use our platform, products and services.  This may include, for example, name, address and contact information, details relating to the services performed, work orders or estimates, communications with end users, payment and billing details, and other end-customer information.   

3. Use of Personal Information

The purposes for which we may process personal information will vary depending upon the circumstances. In general, we use personal information for the purposes set forth below:

  • Providing Services and related support. To provide and operate our Site and Services, communicate with you about your use of the Site and Services, provide troubleshooting and technical support, respond to your inquiries, fulfill your orders and requests, process your payments, communicate with you, and for similar service and support purposes.  

  • Communicating with you. To respond to your inquiries, fulfill your orders and requests, and consider your requests, including (i) to contact you for administrative purposes such as customer service, to address intellectual property infringement, privacy violations or defamation issues related to your content, or (ii) in accordance with applicable laws, to send communications, including updates on promotions, relating to products and services offered by us and by third parties we work with.  Generally, you have the ability to opt-out of receiving any promotional communications as described below under “Your Rights and Choices.”

  • Analyzing and improving Services, Site and our business. To better understand and analyze how users access and use the Site and Services, and our other products and offerings, and for other research and analytical purposes, such as trends and preferences of our users, to evaluate and improve our services and business operations and to develop services and features. 

  • Personalizing experiences. To tailor content we may send or display on the Sites, including to offer location customization and personalized help and instructions, and to otherwise personalize your experiences. 

  • Advertising and marketing: In accordance with applicable laws, to promote our products and services, including on third-party websites, as well as for direct marketing purposes, including to send you newsletters, client alerts and information we think may interest you. If you are located in a jurisdiction that requires opt-in consent to receive certain types of electronic marketing messages, we will only send you such messages if you opt-in to receive them.  

  • Protecting our legal rights and preventing misuse. To protect the Site, Services and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of our Terms of Use or this Privacy Policy.  

  • Complying with legal obligations. To comply with the law or legal proceedings. For example, we may disclose information in response to subpoenas, court order, and other lawful requests by regulators and law enforcement, including responding to national security or law enforcement disclosure requirements. 

  • Related to our general business operations. To consider and implement mergers, acquisitions, reorganizations, and other business transactions, and where necessary to the administration of our general business, accounting, recordkeeping and legal functions.  

Customer Data.  As noted above, ServiceTitan collects and processes Customer Data, as a service provider or processor, on behalf of our Business Customers.  As such, we only process Customer Data in order to provide, improve, operate, protect and secure our platform and the products and services we provide to Business Customers or to comply with applicable contractual or legal requirements.  As permitted under our agreements with Business Customers and applicable law, we may compile, use and process de-identified and other non-identifiable data related to Business Customers and the services we perform and data we collect and process on their behalf, in order to develop and improve our business, products, services and platform and for research and analytics purposes.

4. Disclosures of Personal Information

We may disclose information to third parties in the following circumstances:

  • ServiceTitan affiliates and subsidiaries.  We may disclose personal information about you with our affiliates and subsidiaries pursuant to the purposes described above in Section 3 (Use of Personal Information).

  • Other users.  Any personal information that you voluntarily choose to include on or through the Services, including information in a publicly accessible area of the Services (such as a public profile page) or information you share with or allow to be shared with other users, will be available to anyone who has access to that content, including other users.  We are not responsible for the privacy practices of the other Users who will view and use the posted information.

  • Vendors and service providers.  We work with third party service providers to provide website or application development, IT, system administration and hosting, maintenance, credit card processing, research and analytics, marketing, customer support and data enrichment and other services for us pursuant to the purposes described above in Section 3 (“Use of Personal Information”).  These third parties may have access to or process your personal information as part of providing those services for us.  We limit the information provided to these service providers to that which is necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such information.

  • Advertising and marketing partners.  In accordance with applicable laws, we may share your personal information with our third-party advertising partners to provide ads that we think may interest you.  For more information about our advertising and marketing practices and those of the third-party advertising partners, please see Section 6. (Cookies, Analytics and Advertising).

  • To comply with legal obligations.  We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable laws (such as U.S. copyright law), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.

  • To protect and enforce our rights.  We also reserve the right to disclose your information in order to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the Services and any facilities or equipment used to make the Services available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.

  • In case of merger, sale, or other asset transfer.  Information about our users, our Business Customers and their end-users and end-customers, including personal information, may be disclosed and otherwise transferred to an acquirer, or successor or assignee as part of any potential or actual merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

  • With your consent.  We also may disclose your personal information as described in an Additional Notice, at the time the information is collected, or in any other manner to which you consent, or as otherwise required or permitted by law. 

Customer Data.  As a service provider or processor of Customer Data on behalf of Business Customers, we disclose and process Customer Data in order to provide our Services to Business Customers and subject to the terms of our Business Customer contracts.  As such, we do not disclose the Customer Data that we collect and process on behalf of our Business Customers, except as directed by the relevant Business Customer, as necessary to comply with our applicable legal obligations, and, subject to our legal and contractual obligations, to service providers or processors that perform services on our behalf.  

5. Aggregate and Deidentified Data

We may also use and disclose aggregate, anonymous and other non-identifiable information that is not linked to a particular person, which may include deidentified data, in order to assess, improve and develop our business, products and services, and for research and analytics purposes.  Where we use, disclose or process deidentified data (data that is no longer reasonably linked or linkable to an identified or identifiable natural person, household, or personal or household device) we will maintain and use the information in deidentified form and not to attempt to reidentify the information, except in order to determine whether our deidentification processes are reasonable and adequate pursuant to applicable privacy laws.

6. Cookies, Analytics and Advertising

We and our third-party service providers use “cookies,” pixels, java script, log files, and other mechanisms to automatically collect information on the Site and Services.  The automatically collected information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use the Services, the pages or other content you view or otherwise interact with on the Services, and the dates and times that you visit, access, or use the Services.  We use this information to assess how many users access or use our Services, how they interact with our Services, which content, products, and features of our Services most interest or are of most value to our users, what types of offers and incentives our customers and their end-customers respond to, and how our service performs from a technical point of view. We and the third parties we work with may also use cookies and similar mechanisms to improve our ad campaigns and reach people with more relevant ads and content. 

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site, while others are used to enable a faster log-in process or to allow us to track your activities while using our Site. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future.   Please review your web browser “Help” file to learn the proper way to modify your settings with regard to such automated data collection.  Please note that if you delete, or choose not to accept, such technologies from the Services, you may not be able to utilize the features of the Services to their fullest potential.

Clear GIFs, Pixel Tags. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (also referred to as web beacons, web bugs or pixel tags), in connection with our Services to, among other things, track activities users of our Services, help us manage content, and compile statistics about usage of our Services. We and our third-party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Log Files. Most browsers collect certain information, such as your IP address, device type, screen resolution, operating system version, and internet browser type and version. This information is gathered automatically and stored in log files.

Advertising. We work with third-party ad networks, analytics companies, measurement services and others (“third party ad companies”) to manage our advertising on third-party sites, mobile apps and online services. We and these third party ad companies may use cookies, pixels tags, and other tools to collect activity information on our Services (as well as on third-party sites and services), as well as IP address, device ID, cookie and advertising IDs, and other identifiers, general location information, and, with your consent, your location information. This information is used to provide you more relevant ads and content and to evaluate the success of such ads and content. For more information about third-party ad networks and to opt out of interest-based ads from many ad networks go to http://aboutads.info.

Do Not Track.  Some web browsers incorporate a “Do Not Track” feature.  Because there is not yet an accepted standard for how to respond to Do Not Track signals, our website does not currently respond to such signals.

7. Your Rights and Choices

You may have certain privacy rights under applicable privacy laws, including (subject to certain limitations) the right to access and review your personal information held by us, to request the amendment of incomplete or inaccurate information, to request deletion of certain personal information, and to lodge a complaint regarding our privacy practices.  You may submit a request to us to exercise your privacy rights, as applicable, by contacting us at privacy@servicetitan.com. We will respond to your request as required under applicable privacy law and will request that you provide certain information to enable us to verify you and your request.

In addition, you have other rights and choices regarding your personal information as described in this section.

Account Information.  You may, of course, decline to share certain personal information with us, in which case we may not be able to provide to you some of the features and functionality of the Services.  You may update, correct, or delete your profile information and preferences at any time by accessing your account settings page on the Services.  If you are not a registered user of the Services, if you wish to access or amend any other personal information we hold about you, or if you would like to request that we delete any information about you that we have obtained from a Business Customer, you may contact us at privacy@servicetitan.com.  Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so, to the extent permitted under applicable law.

Opt-Out.  If you receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email.  You may also opt-out from receiving commercial email from us, and any other communications that we may send to you from time to time, by emailing your request to privacy@servicetitan.com or by writing to us at the address given at the end of this policy.  We may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in user account functionality on the Services.  

Please be aware that if you opt-out of receiving commercial email from us or otherwise modify the nature or frequency of communications you receive from us, it may take up to ten business days for us to fully process your request.  Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive transactional and administrative messages from us regarding the Services.

Privacy Settings.  We may also make available certain privacy settings, which enable you to control or limit certain uses, disclosures or other processing activities. We may also allow you to enable certain third party integrations, in order to integrate your ServiceTitan account or certain data with third party services and platforms.  However, please keep in mind that we cannot control the actions of others with whom you may choose to integrate or share your information.  Further, even after information posted on the Services is removed, caching and archiving services may have saved that information, and others, including third parties, may have copied or stored the information available on the Service. 

8. Third-Party Services

This Policy applies only to the processing of your personal information by ServiceTitan. The Services may contain features or links to websites and services provided by third parties.  The policies and procedures described in this Privacy Policy do not apply to third-party sites.  Any information you provide on third-party sites or services is provided directly to the operators of such services and is subject to those operators’ policies, if any, governing privacy and security, even if accessed through the Services.  We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through the Services.  We encourage you to learn about third parties’ privacy and security policies before providing them with information.

9. Children’s Privacy

Protecting the privacy of young children is especially important.  Our Services are not directed to children under the age of 16, and we do not knowingly collect personal information from children under the age of 16 without obtaining parental consent.  If you are under 16 years of age, please do not use or access the Services at any time or in any manner.  If we learn that personal information has been collected on the Services from persons under 16 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information.  If you are a parent or guardian and discover that your child under 16 years of age has obtained an account on the Services, then you may alert us at privacy@servicetitan.com and request that we delete that child’s personal information from our systems.

10. Data Security

We take steps to protect the personal information that we collect.  Regardless of the precautions taken by us, we cannot ensure or warrant the security of any information you transmit to us and there is no guarantee that there will be no unauthorized access, use, disclosure or processing of personal information or that there will not be any breach of our physical, technical, or managerial safeguards.

11. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected or as necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements. After expiry of the applicable retention periods, your personal information will be deleted. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will implement appropriate measures to prevent any further use of such data. In some cases, we may choose to retain certain information (e.g., insights about Services use) in a depersonalized or aggregated form.  

12. Data Transfers

The Services are hosted in the United States and are intended for visitors located within the United States. If you choose to use the Services from other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing.  Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services.  You acknowledge that the governments, courts or law enforcement or regulatory agencies in the U.S. or those jurisdictions may be able to obtain disclosure of the personal information through the laws of the applicable jurisdiction.  By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.

13. Changes and Updates to this Policy

Please revisit this page periodically to stay aware of any changes to this Policy, which we may update from time to time.  If we modify the Policy, we will make it available through the Services and indicate the date of the latest revision. In the event that the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change.  For example, we may send a message to your email address, if we have one on file, or generate a pop-up or similar notification when you access the Services for the first time after such material changes are made.  Your continued use of the Services after the revised Policy has become effective indicates that you have read, understood and agreed to the current version of the Policy.

15. Additional Information for California Residents

This section supplements the information and disclosures contained in our Privacy Policy, and applies to individuals residing in California from whom we collect personal information as a business under California law.  In this subsection, we provide California residents with additional information regarding our collection, use and disclosure of their personal information, as well as their privacy rights, as required by the California Consumer Privacy Act (“CCPA”). This section does not address or apply to our handling of publicly available information or other personal information that is exempt under the CCPA.

Sales and Sharing of Personal Information.  California privacy laws define a "sale" as disclosing or making available to a third-party personal information in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available personal information to a third party for purposes of cross-context behavioral advertising.  While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” or “share” (as defined by the CCPA) identifiers, internet and other electronic activity information and inferences to advertisers, analytics providers and third-party platforms and social networks.  We do so in order to improve and measure our ad campaigns, reach users with more relevant ads and content, and for analytics and research purposes.   We do not sell or share sensitive personal information, nor do we sell or share any personal information about individuals who we know are under sixteen (16) years old.  

Sources of Personal Information.  In the preceding twelve months since this notice was last updated, we have collected personal information from the following categories of sources:

Notwithstanding the above purposes, we only use and disclose sensitive personal information as reasonably necessary (i) to perform services requested by you, (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents, (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct, (iv) to verify or maintain the quality and safety of our Services, (v) for compliance with our legal obligations, (vi) to our service providers who perform services on our behalf, and (vii) for purposes other than inferring characteristics about you.  We do not use or disclose your sensitive personal information other than as authorized pursuant to section 7027 of the CCPA regulations (Cal. Code. Regs., tit. 11, § 7027 (2022)).

Retention.  We retain the personal information we collect only as reasonably necessary for the purposes described above or otherwise disclosed to you at the time of collection.  For example, we will retain your account data for as long as you have an active account with us.  We also maintain the personal information we collect in order to comply with our tax, accounting and recordkeeping obligations, for research, development and safety purposes, and for an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with our legal obligations.

b. CCPA Privacy Rights

If you are a California resident, subject to certain limitations, you have the following rights regarding your personal information:

  • Know/access: You have the right to obtain information (up to twice per year) regarding the: (1) categories of personal information collected, sold, or disclosed by us; (2) purposes for which categories of personal information are collected or sold by us; (3) categories of sources from which we collect personal information; (4) categories of third parties with whom we disclosed or sold personal information; and (5) specific pieces of personal information we have collected about you during the past twelve months.

  • Delete: You have the right to to request deletion of your personal information maintained by us.

  • Opt out of sales and sharing: You have the right to opt out of the sale and sharing of your personal information by us.

  • Limit certain uses and disclosures of sensitive personal information: You have the right to limit the use and disclosure of your sensitive personal information to those authorized pursuant to the CCPA. However, as explained above, we do not use and disclose sensitive personal information about California residents beyond these authorized purposes.

  • Correct: You have the right to correct inaccurate personal information that we maintain about you.

  • Non-discrimination: You have the right to not receive discriminatory treatment for exercising your CCPA privacy rights.

  • Submitting CCPA requests to know/access, correct and delete. California residents may submit verifiable requests to access/know, correct and delete their personal information maintained by us by calling our toll-free number (866) 622-0680 or submitting a request via our online form at http://servicetitan.com/privacy-request.  So that we may verify your request, please provide us with your current name, email address, and phone number in your request and we will reach out to you to obtain additional information, if necessary. We will process your request based upon the personal information in our records that is linked or reasonably linkable to the information provided in your request. If we are unable to adequately verify a request, we will notify the requestor.  Authorized agents may initiate a request on behalf of another individual by contacting us at privacy@servicetitan.com and providing a written authorization from the consumer.  Authorized agents will be required to provide proof of their authorization, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

This California Applicant Privacy Notice (the “Notice”) is provided by ServiceTitan, Inc. and its subsidiaries (“ServiceTitan,” “we” or “us”), pursuant to the California Consumer Privacy Act (Cal. Civ. Code § 1798.100, et seq.), as amended by the California Privacy Rights Act of 2020, and its implementing regulations (“California Privacy Law”).  In this Notice, we describe our collection and processing of personal information related to current and former job applicants, candidates and prospective employees who are residents of California (each an “Applicant”), as well as the rights these Applicants have regarding their personal information.  

1. Scope

This Notice applies only to the personal information that ServiceTitan collects related to California Applicants and is intended to satisfy ServiceTitan’s applicable notice obligations under the CCPA. We may also provide additional notices to Applicants about our data collection practices that are covered by other laws (such as if we conduct a background check).

 This Notice does not address or apply to our collection of personal information that is not subject to the CCPA, such as (i) protected health information, consumer credit reports and background checks, publicly available data lawfully made available from state or federal government records, or other information that is exempt under the CCPA; (ii) the personal information that we collect about Applicants and other individuals who are not residents of California; or (iii) the personal information we collect from employees, contractors, officers and directors, which is subject to other notices and not this one.

Our collection and processing of personal information may vary depending upon the circumstances, such as the role, responsibilities, location, and qualifications associated with a position. The information in this Notice is intended to provide an overall description of our collection and use of personal information about Applicants.

The table below identifies, generally, the categories of personal information we have collected about Applicants, as well as the categories of third parties to whom we may disclose this information for a business or commercial purpose (subject to applicable laws).

Retention. We retain the personal information we collect only as reasonably necessary for the purposes described below or otherwise disclosed to you at the time of collection. For example, we will retain your information as necessary to comply with our tax, accounting and recordkeeping obligations, to consider you for additional positions, as well as an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with our legal obligations.

Purposes for Processing Personal Information. Subject to applicable legal restrictions, generally, we collect, use, disclose and otherwise process Applicant personal information for the following business and commercial purposes:

  • Recruiting, hiring, managing and evaluating Applicants: to review, assess, recruit, consider or otherwise manage the recruiting process and job applications, including:

    • Scheduling and conducting interviews;

    • Identifying potential candidates, including by working with external recruiters;

    • Reviewing, assessing and verifying information provided, to conduct criminal and background checks (where relevant and pursuant to applicable law), and to otherwise screen or evaluate Applicant qualifications, suitability and relevant characteristics;

    • Extending offers, negotiating the terms of offers and assessing salary and compensation matters

    • Satisfying legal and regulatory obligations;

    • Communicating with California Applicants regarding their applications and about other similar position(s) for which they may be interested;

    • Maintaining California Applicant personal information for future consideration; and

    • Supporting our equal opportunity employment policy and practices.

  • Onboarding: where applicable, to conduct pre-employment checks, work with you to complete new hire paperwork, enroll you in our HR and other relevant systems, and set up your personnel file.

  • Security and monitoring: to monitor and secure our resources, network, premises and assets, including:

    • Detecting, preventing and investigating suspected or alleged misconduct or violations of work rules;

    • Detecting, preventing, investigating, mitigating and responding to security and privacy incidents;

    • Implementing and managing physical and technical access controls; 

    • Monitoring activities, access and use to ensure the security and functioning of our systems and assets; and

    • Securing our offices, premises and physical assets, including through the use of electronic access systems and video monitoring.

  • Health and safety: for health and safety purposes, such as contact tracing or conducting appropriate screenings of individuals prior to entering or accessing certain locations or premises.

  • Auditing, accounting and corporate governance: relating to financial, tax and accounting audits, and audits and assessments of our business operations, security controls, financial controls, or compliance with legal obligations, and for other internal business purposes such as administration of our records retention program.

  • M&A and other business transactions: for planning, due diligence and implementation of commercial transactions, for example mergers, acquisitions, asset sales or transfers, bankruptcy or reorganization or other similar business transactions.

  • Defending and protecting rights: to protect and defend our rights and interests and those of third parties, including to manage and respond to legal claims or disputes (including Applicant claims and disputes), and to otherwise establish, defend or protect our rights or interests, or the rights, interests, health or safety of others, including in the context of anticipated or actual litigation with third parties.

  • Complying with legal obligations: relating to compliance with applicable legal obligations (such as hiring eligibility, responding to subpoenas and court orders) as well as assessments, reviews and reporting relating to such legal obligations, including under employment and labor laws and regulations, Social Security and tax laws, environmental regulations, workplace safety laws and regulations, and other applicable laws, regulations, opinions and guidance.

Sensitive Personal Information. We do not use or disclose Applicant sensitive personal information for purposes beyond the permissible purposes authorized by the CCPA (pursuant to Cal Civ. Code § 1798.121 and § 7027(l) of the CCPA regulations).  Accordingly, we only use and disclose sensitive personal information about California Applicants as reasonably necessary and proportionate: (i) to perform our services requested by you; (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents; (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct; (iv) to verify or maintain the quality and safety of our services; (v) for compliance with our legal obligations; (vi) to our service providers who perform services on our behalf; and (vii) for purposes other than inferring characteristics about you.

Sales and Sharing. We do not ‘sell’ or ‘share’ for ‘cross-context behavioral advertising’ purposes (as defined by the CCPA) any Employee personal information (including about individuals we know are minors).

CCPA Rights of Applicants. Subject to certain limitations and exceptions, Applicants (who are residents of California) generally have the following rights under the CCPA with respect to their personal information collected and processed by us:

  • Right of deletion: to request deletion of their personal information that we have collected about them and to have such personal information deleted (without charge), subject to certain exceptions.

  • Right to know (access): to request that we (i) disclose the categories and sources of personal information we have collected about them, the categories of personal information disclosed, sold and shared, the categories of third parties to whom we have sold, shared or disclosed such personal information, and the business or commercial purposes for which we collect, use, disclose and process their personal information, and (ii) provide them with a copy of the personal information we have collected about them (in a portable format to the extent practicable).

  • Right to correct: to request that a business that maintains their inaccurate personal correct that personal information.

  • Right to non-discrimination: to not to be subject to discriminatory treatment for exercising their rights under the CCPA.  

Submitting CCPA Requests. Applicants may exercise their CCPA rights by submitting a Privacy Request online or calling our toll-free number (866) 622-0680.  We will take steps to verify your request, such as by (i) sending a confirmation email to your email address on record with us (which you must take action to confirm), and/or matching the information provided by you with the information we have in our records.In some cases, we may request additional information in order to verify your request or where necessary to process your request. If we are unable to adequately verify a request, we will notify the requestor.  Authorized agents may initiate a request on behalf of another individual via email; authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.
